the terms of sale set out here apply to goods supplied by danene elise art, mansfield, ma, ordered from the danene elise art website at www.daneneelise.com. by continuing with a purchase it is deemed that you have read, understood and agree to these terms and conditions.

 

you must be 16 years of age or older to order from the website and by accepting these terms and conditions you are confirming this.

danene elise art reserves the right to change these terms and conditions without notice to you in relation to future sales.

 

these terms do not create any rights to any parties other than the purchaser.

 

orders and prices

danene elise art uses Paypal as their online purchasing system.

danene elise art accepts payment by any of the credit cards shown as acceptable on the website at time of purchase.

 

all prices are shown in US dollar and are subject to delivery charges unless otherwise stated unless otherwise stated. these charges where applicable will be added on confirmation of your address and payment details and prior to the order being placed during the payment process.

all prices may be subject to change. prices for specific works may rise as an edition begins to sell out.

 

the description and price of goods will be as shown on the website at the time you place your order. every effort will be made to ensure that prices shown on the website are accurate at the time of purchase. if an error is discovered prior to despatch of your order, danene elise art will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or canceling your order. 

 

when ordering online your order will be sent to danene elise art through Paypal by email. you will also receive an email receipt to confirm danene elise art has received your order. should you not receive an email please contact danene elise art by email at daneneelise@gmail.com.

if you are shopping from outside the US, please contact the gallery directly at daneneelise@gmail.com to place your order as terms and conditions, shipping prices and delivery times will differ to those stated on our website.

all goods are subject to availability. If on receipt of your order the goods are out of stock, danene elise art will inform you and refund or re-credit you for any sum that has been paid by you for the unavailable goods.

 

danene elise art is under no obligation to accept any order.

 

delivery

all delivery times quoted on the danene elise art website are estimates based on availability, normal processing and delivery times. danene elise art may deliver items from the same order separately but will charge for postage and packing as per the original order.

goods ordered will be delivered to the address given when the order was placed, subject to receipt of an order confirmation email.

 

all work will be sent to you by courier service. danene elise art will endeavor to package and ship purchased art within 14 days (within the USA) of receipt of payment unless otherwise stated on the website, or advised by email from the gallery at the time of purchase.

 

if there is no one available at the delivery address to accept delivery of couriered goods, you will be notified of an alternative delivery date or place to collect the goods (USA). danene elise art cannot accept responsibility for large goods that are returned to the post office and remain uncollected.

a signature will be required on delivery for couriered and special delivery purchases. Receipt of a signature at the delivery address for any order will act as proof that the order has been delivered to you. 

​

once the art work is considered delivered, responsibility for the work, risk of damage or loss will pass to you and you shall be responsible for insuring the work.

 

if danene elise art is unable to deliver your order within 30 days, the gallery will inform you as soon as possible and you will be entitled to cancel the order and obtain a full refund that will be paid to the credit or debit card with which you originally paid for your order.

danene elise art is not liable for any loss or damage suffered by you through any unavoidable delay in delivery of an order. danene elise art is not liable for any damage which occurs to an order after a delivery has been made.

ownership and copyright

 

once an art work is in your possession you may not publish or submit for publication or reproduction any image of an art work to any third party including the internet for any purpose. Copyright belongs to the artist danene elise. images of sold paintings may still be used by danene elise art for any future use including but not limited to advertising, books and other publications, social media and other web based use.
